1. Service Description

OptikLabs is an AI-powered marketing platform designed for service businesses. The platform provides content generation and scheduling, email triage and drafting, client relationship management, analytics and insights, SEO auditing, and blog management.

These Terms of Service ("Terms") govern your access to and use of the OptikLabs platform. By creating an account, you agree to be bound by these Terms.

2. Account Responsibilities

You must be at least 18 years of age to create an account
You are responsible for maintaining the security of your account credentials
Each account is limited to one business profile, unless you are on the Team plan (which supports up to 10)
You must provide accurate and complete information during registration
You are responsible for all activity that occurs under your account

3. Acceptable Use

You agree not to use OptikLabs to:

Generate, distribute, or publish illegal, harmful, or defamatory content
Send unsolicited bulk messages (spam) through connected email or social accounts
Impersonate other individuals or businesses
Abuse AI generation features to produce misleading or deceptive content
Attempt to reverse-engineer, exploit, or compromise the platform
Violate any applicable laws or regulations, including CASL (Canada's Anti-Spam Legislation)

4. Subscription & Billing

OptikLabs offers three subscription plans, billed monthly:

All plans include a 14-day free trial
Payments are processed securely through Stripe
You may cancel your subscription at any time — cancellation takes effect at the end of the current billing period
No refunds are issued for partial months of service

5. Content Ownership

You own your data. All business data, client information, and content generated through OptikLabs belongs to you. We claim no ownership over user-generated content.

You grant OptikLabs a limited, non-exclusive license to process your data solely for the purpose of providing the service.

6. AI-Generated Content

Content generated by OptikLabs is AI-assisted and intended as drafts for your review.

You are solely responsible for reviewing, editing, and approving all content before publishing
OptikLabs is not liable for any consequences arising from published AI-generated content
AI-generated content may occasionally contain errors or inaccuracies — always review before use

7. Third-Party Integrations

OptikLabs connects to third-party services (Google, Meta, LinkedIn, Stripe) at your discretion. You authorize these connections and acknowledge that:

Third-party services are governed by their own terms and privacy policies
OptikLabs is not responsible for outages, data loss, or policy changes by third-party providers
You may disconnect third-party integrations at any time through your account settings

8. Service Availability

We strive to maintain high availability of the OptikLabs platform. However, at this stage we do not offer a formal Service Level Agreement (SLA). The service is provided on a best-effort basis.

Scheduled maintenance and updates may occasionally result in brief periods of downtime. We will endeavour to notify users of planned maintenance in advance.

9. Limitation of Liability

To the maximum extent permitted by law, OptikLabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.

Our total aggregate liability for any claims arising from or related to the service shall not exceed the total amount paid by you to OptikLabs in the 12 months preceding the claim.

10. Termination

Either party may terminate the service relationship at any time:

You may cancel your account through the billing settings or by contacting support
We may suspend or terminate accounts that violate these Terms
Upon termination, your data will be available for export or permanently deleted within 30 days

11. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law principles.

In the event of any dispute, the parties agree to first attempt resolution through good faith negotiation. If a resolution cannot be reached, the dispute shall be submitted to the courts of the Province of Ontario.

12. Changes to These Terms

We reserve the right to update these Terms at any time. Material changes will be communicated via email. Your continued use of OptikLabs after such notification constitutes acceptance of the revised Terms.
